Mold in South Dakota: an east-west split and no licensing at all

South Dakota licenses no mold professionals, and it does not license general contractors either. Its health department says plainly that mold inspection and cleanup is the homeowner's duty. Here is the NOAA humidity record, the statute that does apply, and how to vet a contractor in a state that regulates almost none of them.

The South Dakota humidity profile

South Dakota splits cleanly at the Missouri River, and the NOAA stations show it. Huron and Aberdeen report a 72 percent annual mean relative humidity, Sioux Falls 71, and Rapid City in the western hills 60. The morning column splits harder still: 82 to 84 percent in the east, 68 percent at Rapid City. That is a 12-point gap on the annual mean and a 16-point gap in the morning, inside one state under one set of laws.

The eastern half behaves like the rest of the upper Midwest. Relative humidity peaks in December at 74 percent, in the month every building is sealed and heated, and the calculated annual mean dew point runs 36 to 38 F. Cold air holds little water, so the moisture that matters through the winter is generated indoors and condenses on cold glass and inside cold wall cavities. NOAA notes that with no mountain range to its north the state takes arctic air masses head on, and January averages run below 10 degrees Fahrenheit in the northeast.

The bulk-water story is rivers, and South Dakota's version is unusual for how long it lasts. NOAA's state climate summary calls flooding a great hazard because several large rivers run through the state, and notes that since 1990 South Dakota has averaged 22 percent more 2-inch rain events than its long-term average. The 2019 event is the clearest case: wet antecedent conditions, repeated winter storms and relentless spring rain put the James River at Columbia above flood stage for 518 days, which NOAA calls unprecedented in the Missouri River basin. In June 2011, record Rocky Mountain snowpack runoff held the Missouri above flood stage at Pierre from May 24 to September 7, a four-month soak. Of 36 billion-dollar disasters affecting the state from 1980 to 2024, five were floods, and those five carry roughly a quarter of the total cost.

Relative humidity figures are the mean of the morning and afternoon observations NOAA publishes for each first-order station, rounded to whole percent. Dew point is calculated from the NOAA normal mean temperature and that mean relative humidity using the Magnus formula, so treat it as a derived figure rather than a published one.

Sioux Falls takes 27.9 inches a year against 17.4 at Rapid City. Bulk water is the mechanism behind most basement and crawl space mold, so the wettest station is the one to plan around.

02Station record

South Dakota stations ranked by measured humidity

Methodology

Methodology. Ranked by annual mean relative humidity, the one input that traces to a station record rather than an opinion. Relative humidity is the mean of NOAA's published morning and afternoon values. Mean dew point is calculated from the NOAA 1991 to 2020 normal mean temperature and that mean relative humidity. The humidity band names what the column measures and nothing more. Humidity is not the whole story: a burst supply line in the driest metro on this table soaks the same drywall as a humid August, and EPA guidance treats wet porous material as at risk of mold growth after 24 to 48 hours either way.

The Missouri River is the line, and it is a real one. Rapid City at 60 percent and Huron at 72 percent are not the same climate and should not get the same advice. East River, treat the house like an upper Midwest house: watch the basement, run a dehumidifier through late summer, and expect winter condensation to do real work on windows and wall cavities. West River, treat it like a semiarid house: if mold appears, something is leaking, and finding the leak is the job.

Sioux Falls carries the most water even though Huron reads higher. Its calculated mean dew point of 38 F is the state's highest, and it takes 27.9 inches of rain against Rapid City's 17.4. Dew point does not move with temperature the way relative humidity does, so for deciding whether a basement wall will sweat, use the dew point column. 03Biological record

Common mold species in South Dakota homes

EPA and CDC name the same core genera across both halves of the state. East River they concentrate in basements and at cold winter surfaces; West River they appear only where a pipe or an appliance has failed.

Cladosporium

Cladosporium spp.

The most commonly found indoor mold nationwide and the standard South Dakota window-sill and basement-joist find. Olive-green to black, usually a fine speckle before it becomes a patch. EPA lists it among the common allergenic indoor molds.

Penicillium

Penicillium spp.

Blue-green and powdery, on cardboard, paper, carpet padding and stored fabric. In a basement that took river or snowmelt water, it is the first thing to appear. EPA lists Penicillium among the most frequently recovered genera in indoor air samples.

Aspergillus

Aspergillus spp.

Black, green or brown depending on species. It wants steady moisture and organic dust: bathroom grout, the cabinet under a slow-leaking sink, the back of a closet on an exterior wall. EPA and CDC flag Aspergillus species as allergens and, in rare cases, as a cause of aspergillosis in people who are immunocompromised.

Stachybotrys chartarum

Stachybotrys chartarum

The species commonly called toxic black mold. It needs sustained wet cellulose, and a South Dakota flood that runs for months rather than days is exactly the condition it wants. Visible black slimy growth on water-stained drywall is the signature. Do not disturb it. Cut it out.

Alternaria

Alternaria alternata

Dark green to black, on window tracks, shower stalls and condensation-prone surfaces. It is a common allergen panel entry and is often correlated with asthma flare-ups in sensitive individuals per EPA remediation guidance.

Chaetomium

Chaetomium spp.

Olive to grey and cotton-textured. It requires chronic moisture, so finding it means water has been present for seasons. After a long-duration flood like 2019, that is exactly what happened, and it usually means the material was never properly dried.

Species information is general and informational. Health responses vary. See a licensed physician for symptom evaluation. 04Cost drivers

What mold remediation costs in South Dakota

No South Dakota agency publishes a mold remediation price schedule, and the Department of Health is direct about the boundary of its role: it does not provide mold sampling services, so residents must hire an environmental contractor to sample, and mold inspection and cleanup is the duty of the homeowner. That is a state telling you the whole problem is yours, which at least has the virtue of clarity.

The biggest cost driver here is flood duration rather than flood depth. A river that stays above stage for months, as the James did for 518 days in 2019, does something a flash flood does not: it keeps the ground water table high, so a basement that is pumped out refills, and material that is dried gets wet again. In that situation drying equipment runs for weeks rather than days, and the honest scope is often to remove the finished basement rather than to keep drying it. Ask any bidder what their plan is if the water table stays up.

The second driver is distance. South Dakota is large and thinly populated, and restoration contractors cluster in Sioux Falls and Rapid City. A job in Aberdeen or Pierre may carry travel and equipment mobilization that the same job in Sioux Falls does not. Ask about mobilization explicitly.

The third is that neither mold work nor general contracting is licensed by the state, so bids will differ in scope as much as in price. Get an itemized written scope from each bidder. Our national mold remediation cost guide covers the drivers that move a quote in any market, and the cost estimator lets you scope your own job first.

On insurance: overland flooding is excluded from a standard homeowners policy, and sewer and drain backup usually needs a separate endorsement. Flood coverage comes from the National Flood Insurance Program and carries a 30-day waiting period, which matters in a state where spring flooding is forecast from snowpack. Sudden and accidental discharge such as a burst pipe is normally covered. Take coverage questions to the South Dakota Division of Insurance, and read our guide to homeowners insurance and mold.

05Licensing

Mold remediation licensing in South Dakota: who can legally do the work

Finding 01 / Licensing South Dakota does not license, certify or register mold assessors or mold remediators, and it goes further than almost any state: it does not license general contractors either.
The Department of Labor and Regulation's full list of occupational and professional licensing boards runs from abstracters to real estate, and the only construction trades on it are the Electrical Commission and the Plumbing Commission. Source: SD Department of Revenue: Contractor's excise tax.

South Dakota does not license, certify or register mold assessors or mold remediators, and it goes further than almost any state: it does not license general contractors either. The Department of Labor and Regulation's full list of occupational and professional licensing boards runs from abstracters to real estate, and the only construction trades on it are the Electrical Commission and the Plumbing Commission. There is no contractor board and no mold board.

What every construction firm in the state does need is a contractor's tax license from the Department of Revenue. That is a tax registration rather than a competency credential: anyone contracting for construction services, or for the construction, building, installation or repair of a fixture to real property, must hold one and pay a 2 percent excise tax on gross receipts. It proves the company is registered with the state for tax purposes. It proves nothing about the work.

The Department of Health confirms the gap from the other direction, telling residents that it does not provide mold sampling services and that mold inspection and cleanup is the duty of the homeowner. Between those two facts, South Dakota is close to the most deregulated mold market in the country, and every part of the vetting is yours.

So build it deliberately. Confirm the contractor's tax license with the Department of Revenue, which at least establishes the business exists as a registered entity. If the job includes electrical or plumbing work, those two trades are licensed and their commissions run lookups, so use them. Then ask the remediation questions the state will not: IICRC certification, whether the work will follow ANSI/IICRC S520, whether the same firm is doing the assessment and the remediation, and daily moisture readings by material. Ask for two references from jobs finished in the last year within a hundred miles, and call them.

06Statute

South Dakota mold laws and tenant rights

South Dakota has no mold-specific statute. A mold complaint runs through SDCL § 43-32-8, which requires the lessor of residential premises to keep the premises and all common areas in reasonable repair and fit for human habitation and in good and safe working order for the whole term of the lease, and to maintain all electrical, plumbing and heating systems, unless the disrepair was caused by the tenant's negligent, willful or malicious conduct. The parties cannot waive or modify that duty, though the lessor may agree that the tenant performs specified repairs in lieu of rent. A mold complaint runs through "fit for human habitation."

The remedy at SDCL § 43-32-9 is a reasonable-time standard rather than a fixed clock. After notice to the lessor of conditions requiring repair, and a reasonable time with no action, the tenant may repair the condition and deduct the cost from rent, recover it from the lessor, or vacate and be discharged from further rent.

South Dakota then adds an escrow route for larger repairs, which is the provision most tenants do not know about. If the cost of necessary repairs exceeds one month's rent, the tenant may, after written notice stating the specific reason for withholding, withhold rent and deposit it in a separate escrow account maintained only for making the repairs, giving written evidence of that account to the lessor. Mold remediation frequently exceeds a month's rent, which puts it squarely in this route.

Two practical points. First, the escrow account has to be real and separate, and the lessor has to get written evidence of it, so this is not the same as simply not paying. Second, because the statute uses "a reasonable time" rather than a day count, the record you build is the case: dated written notice, photographs of the growth and the water source, and a note of every response. Our landlord letter generator produces that notice, and our guide to mold and apartment rights covers the general playbook. Talk to a South Dakota attorney before withholding anything.

General information, not legal advice. For your situation, talk to a South Dakota attorney, a legal aid office, or your local tenant council.

07Actions

South Dakota-specific actions

Two climates, one law, and no licensing. Three moves cover most of the controllable risk on either side of the Missouri.

A. East River, own the basement from July through September

Huron and Aberdeen post morning humidity in the low to mid 80s while basement floors are still holding spring's cold, which is the widest gap of the year between the moisture in the air and the temperature of the surfaces it touches. Opening a basement window on a humid August morning makes the walls wetter. Run a dehumidifier with a condensate pump and hold the space below 50 percent. Outside, direct downspouts at least six feet from the foundation, grade soil away, and test the sump and its backup before spring. Our indoor humidity calculator shows measured relative humidity plus calculated dew point.

B. Plan for a flood that lasts months, not days

The 2019 James River flood ran above stage for 518 days and the 2011 Missouri flood held Pierre above stage for more than three months. That changes the plan: a long-duration flood keeps the water table high, so pumping and drying have to continue rather than finish, and the realistic answer for a finished basement is often removal rather than repeated drying. Know your flood-plain status, carry National Flood Insurance Program coverage if you need it (30-day waiting period, so buy before the forecast), and check whether you have a sewer and drain backup endorsement.

C. Run indoor humidity down through the heating season

With January averages below 10 F in the northeast and a calculated mean dew point in the mid 30s, the moisture that matters in a South Dakota winter is the moisture you generate indoors. Target roughly 30 to 35 percent indoor relative humidity, not 50. Run bath and kitchen exhaust fans on a timer, confirm the dryer vents outdoors and that the flap opens, and turn a furnace humidifier down in January. Condensation running down onto window sills is the signal you are over the line.

December through February is the indoor-moisture window. The daily mean sits at 72 to 74 percent while the air outside carries almost no water. In a sealed, heated house every cold surface becomes a condensation target, and window sills and exterior-wall closet corners go first. The fix is ventilation and a lower indoor humidity target, not a dehumidifier.

June through August is the East River basement window. The morning mean reaches 82 to 83 percent while basement floors are still cool, which is when Penicillium takes hold on stored cardboard and carpet padding. Run the dehumidifier through this stretch even when upstairs feels comfortable.

Spring is the river window and it can run long. Snowmelt over frozen ground plus upstream Rocky Mountain runoff is what put the Missouri above flood stage at Pierre for over three months in 2011. Watch river stage rather than the calendar, and remember that a long flood is a different problem from a flash flood. The mold risk by ZIP tool gives you the local read.

Questions on file

Does South Dakota require a license for mold remediation?

No, and South Dakota does not license general contractors either. The Department of Labor and Regulation's full list of occupational and professional licensing boards contains only two construction trades, the Electrical Commission and the Plumbing Commission. There is no contractor board and no mold board. Every construction firm does need a contractor's excise tax license from the Department of Revenue, which is a tax registration at 2 percent of gross receipts rather than a competency credential. If the job includes electrical or plumbing work, those two trades are licensed and their commissions run public lookups.

How long does a South Dakota landlord have to fix mold?

The statute says a reasonable time rather than a fixed number of days. SDCL § 43-32-8 requires the lessor to keep residential premises in reasonable repair and fit for human habitation and to maintain electrical, plumbing and heating systems, and the duty cannot be waived. Under § 43-32-9, after notice and a reasonable time with no action, the tenant may repair and deduct, recover the cost from the lessor, or vacate and be discharged from further rent. If the necessary repairs cost more than one month's rent, the tenant may withhold rent after written notice stating the specific reason and deposit it in a separate escrow account maintained only for the repairs, giving the lessor written evidence of that account.

Will the state of South Dakota test my home for mold?

No. The Department of Health states on its own mold page that it does not provide mold sampling services and that residents must hire an environmental contractor to sample, and that mold inspection and cleanup is the duty of the homeowner. That page is still worth reading because it covers the dampness sources that cause mold, how to tell you have a problem, prevention, and why testing is not recommended as a first step. It links to EPA's brief guide to mold, moisture and your home and to guidance on flood-damaged homes.

Is South Dakota one climate for mold purposes?

No, and the split is one of the sharpest in this report. Huron and Aberdeen report a 72 percent annual mean relative humidity with morning means in the low to mid 80s. Rapid City, in the Black Hills, reports 60 percent with a 68 percent morning mean. That is a 12-point annual gap and a 16-point morning gap inside one state. East River, humidity and basements do real work. West River, mold means something is leaking, and the diagnosis is the job.

What was different about the 2019 South Dakota flood?

Its duration. Wet antecedent conditions, repeated winter storms and relentless spring rain put the James River at Columbia above flood stage for 518 days, which NOAA describes as unprecedented in the Missouri River basin. A flood that long keeps the ground water table high, so a basement that gets pumped refills and material that gets dried gets wet again. That changes the remediation answer: for a finished basement, removal is often more honest than repeated drying. The 2011 Missouri flood did something similar, holding Pierre above stage from May 24 to September 7.

How do I vet a mold contractor in South Dakota?

You have to build the whole check yourself, because the state licenses almost nothing here. Confirm the contractor's excise tax license with the Department of Revenue, which at least establishes a registered business. If electrical or plumbing work is involved, use those two commissions' lookups, since they are the only construction trades South Dakota licenses. Then ask for IICRC certification, ask whether the work will follow ANSI/IICRC S520, ask whether the same firm is doing the assessment and the remediation, ask for daily moisture readings by material, and get two references from jobs finished in the last year within a hundred miles. Then call them.
